CITY of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 3166_________ <br />WHEREAS, by allowing said properties to go tax forfeit, <br />the property owner gives up any substantial property rights for <br />use of said property, and therefore the City's refusal to provide <br />sanitary sewer service to said Lots 3 and 4 would not deny e <br />property owner of a substantial property right; and <br />WHEREAS, the parcel is unbuildable unless sewer is <br />provided or the property is attached to adjacent vacant parcels <br />because of insufficient room to provide for house, well, and <br />primary and future septic system drainfields. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of <br />the City of Orono, Minnesota that sewer service will not be <br />provided to Lots 3 and 4, Block 3, Bayside Addition to LaJce <br />Minnetonka, because the property is substandard in area, is <br />intended by its owner to be allowed to go tax forfeit, is <br />adjacent to other vacant land which will be provided with <br />municipal sewer service and to which this property could be <br />attached to create a single buildable site that, while still <br />substandard, wou?.d more closely meet the 2 acre requirement for a <br />buildable lot than would the properties taken individually. <br />Adopted by the City Council of the City of Orono, <br />Minnesota on this 10th day of August, 1992. <br />ATTEST: <br />Barbara A.
