Non-Conforming Use. Notwithstanding any other provision of this <br />Chapter, any non-conforming use of land not involving a structure and any non-conforming use <br />involving a structure with an assessor ’s fair market value on January 1, 1975, of $3,000.00 shall be <br />allowed to continue as a non-conforming use subject to the provisions as set forth in Section 10.03. <br />except that the provisions of this Chapter relating to the elimination of non-conforming use of boat <br />slips, boat buoys, or overall length of docks, their location, construction, and maintenance and boat <br />mooring areas, shall supersede any other non-conforming use provisions of the Cit>’ Code. <br />A. Elimination of Non-Conforming Use of Boat Slips, Boat Buoys or Overall <br />Length of Docks. Any marina operator who increases the number of boat slips, boat buoys or <br />overall length of docks beyond w hat he was previously licensed for by the City, which increases are <br />authorized by ordinances of the Lake Minnetonka Conservation District, shall first decrea.se an <br />equivalent number of boat slips or boat buoys and eliminate an equivalent length of dock from that <br />portion of his dock that is non-conforming under the terms of Ordinance No. 1 of the Lake <br />Minnetonka Conseivation District until the dock conforms in length to the Lake Minnetonka <br />Conservation District’s Ordinances. <br />Subd. Variances. Variances may be granted to the provisions of this Chapter <br />in accordance with the provisions set torth in Section 10.08. <br />Subd. 14r IT Variances For Required Landscaping Areas.
