• <br />m <br />z'/f <br />“ 5. c S •/ <br />12/9/86 ■j: <br />DECLARATION OF COVENANTS» EASEMENTS <br />AND RESTRICTIONS <br />THIS DECLARATION is made this 15th day of December, <br />1986, bv Woodhill Country Club, a Minnesota corporation <br />("Woodhi11")? John D. Prudden and Stephanie Prudden, husband ana <br />wife (the -Pruddens"); and John S. Pillsbury, Jr., and <br />Katharine C. Pillsbury, husband and wife (the Pillsburys ). <br />Woodhill, the Pruddens and the Pillsburys are hereinafter <br />occasionally referred to collectively as "Declarants. <br />RECITALS <br />The Pillsburys have entered into a (Contract for Deed <br />(the "Contract for Deed") with Woodhill in which Woodhill has <br />purchased a tract of land of approximately 34 acres located in <br />the County of Hennepin, State of Minnesota, legally described on <br />County, Minnesota as Document No. » anc in .he Hennepin <br />County Registrar of Titles Office as Document No. 1714972. <br />The Pruddens are the owners of a tract of land of <br />aoproximately 8.36 acres located in the County of Hennepin, State <br />of Min.nesota, legally described on Exhibit B (the Prudden <br />”) # which is conti5^^'^s to ths Woodhill PropcTwy. <br />Declarants desire to subject the Woodhill Property and <br />the Prudden Property to various covenants, easements, and <br />restrictions. <br />NOW, THEREFORE, Declarants hereby declare that upon the <br />recording hereof the Woodhill Property and the Prudden Property <br />and any part therein shall be transferred, held, sold, conveyed, <br />and occuoied, subject to the following covenants, easements, and <br />restrictions, which are for the purpose of protecting the value <br />end desirability of the Woodhill Property and the Prudden <br />property and all parts therein and which shall be binding <br />permanently on all parties having any right, title, or interest <br />in the same, their heirs, successors, and assigns; shall ^^vre to <br />the benefit of each owner thereof; and shall run with the land. <br />1. A non-exclusive easement is hereby created in <br />favor of the Prudden Property for driveway purposes (including <br />the right of access for such repairs and maintenance deemed <br />reasonably necessary by the owners of the Prudden Property) over <br />that portion of the Woodhill Property described on Exhibit C, <br />(the "Driveway Easement").
