MN S5323 <br />Dear Members: <br />1 have owned this lot for 34 years and wish to construct a house <br />on it. Prior to the new shoreland regulations of a year ago the <br />setback from the pond was 26 feet and there was adequate room to <br />build. This lot was not originally designed with a 7b foot <br />setback in mind. Due to the meandering creek the 7b foot setback <br />can not be met. The proposed setbacks as shown on the site plan <br />are comparable to the adjoining structures. One could question <br />whether the setback should even be measured from the edge of the <br />pond since the homeowners are responsible for the existence and <br />maintenance of the dam and the centerline of the original creek <br />is much farther away. <br />I have looked at moving closer to Leaf Street but in prior <br />meetings with the council a 25 foot road easement was agreed upon <br />since no road easement presently exists. This already brings <br />me 0 feet closer than in other places on Leaf Street which have <br />a 33 foot easement. Even though Leaf Street is being <br />reconstructed to its original narrow width at this time, there is <br />a good possibility that it could be widened in the future causing <br />the house to be even closer to the road. <br />Concerning drainage and runoff into the pond, there is less <br />direct runoff from the proposed house since more runoff would be <br />running west first and taking a longer route through grass areas <br />to eventually reach the creek. Also, the area in front of the <br />dam is a very large sediment basin anyway. <br />This proposed house fits in well with the existing contours so <br />that very little grading outside of the foundation is necessary. <br />The adjoining lots have garage and sheds much closer to the pond <br />than this proposal and the setbacks being proposed are certainly <br />well in line with the neighborhood considering the unique <br />topographic features and creek location on this lot. <br />Sincerely, <br />Donald R.
