Date Application Received: 08/23/2023 <br />Date Application Considered as Complete: 10/06/2023 <br />60-Day Review Period Expires: 12/05/2023 <br />To: Chair Bollis and Planning Commission Members <br />Adam Edwards, City Administrator <br />From: Melanie Curtis, Planner MCC <br />Date: 16 October 2023 <br />Subject: #LA23-000051, Keplinger & Keranen Builders, Inc., o/b/o Erik & Marissa Winegarden, <br />2795 Shadywood Road <br />■ Variances and CUP <br />■ Public Hearing <br />Application Summary: The applicant is requesting the following in conjunction with redevelopment of the <br />property with a new home: <br />o Lot area and Lot Width variances; <br />o Variance for hardcover within the 75-foot setback; <br />o Average lakeshore setback variance for the new deck; and <br />o A 75-foot lake setback variance (from the lake and channel) for building improvements. <br />Additionally, a conditional use permit is required in order to permit the required 15-foot fill bench to be less <br />than 15-feet on the sides of the home in conjunction with elevating the home above the regulatory flood <br />ion elevation on fill. <br />Staff Recommendation: Planning Department Staff recommends partial approval of the application. See page <br />7 for full recommendation. <br />Background <br />The existing home on the property is situated within the 75-foot setback from the Narrows Channel. <br />Approximately 70% of the 0.75-acre property is within the 75-foot setback from the lake and channel. The <br />property line does not abut the concrete seawall on the channel as there is an approximate 3.5' foot strip of <br />land owned by Hennepin County (highlighted in yellow on the existing conditions survey; Exhibit D). There are <br />hardcover improvements within the 75-foot setback (from the channel and the lake), and the home is <br />nonconforming with respect to FEMA floodplain regulations relating to the low floor elevation and the adjacent <br />grades. <br />The owners plan to build a new home on the existing footprint with a garage addition as well as other <br />hardcover changes/improvements on the property. Their plans involve elevating the new home on fill to comply <br />with FEMA regulations and bring the home up to modern standards with respect to ceiling heights resulting in <br />an increase of mass within the 75-foot setback. The applicant's proposal contemplates cutting and filling within <br />the property in order to elevate the proposed home to meet the floodplain regulations. As a result of the <br />required fill and the changes to the structure of the home, the overall height is proposed to increase by <br />approximately 14 feet over existing conditions. <br />PROPOSED - West Lake Side Elevation Comparisons EXISTING - <br />West <br />
