CITY <br />OF <br />ORONOJ City of OROIVO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 2455 <br />A I^SOLDTION APPROVING THE PLAT OF <br />BAYSIDB LANDING <br />APPLICATION NO. 1171 <br />WHEREAS, the City of Orono is a municipal corporation organised <br />and existing under the laws of the State of Minnesota; and <br />WHEREAS, the City Council of the City of Orono has adopted <br />subdivision regulations for the orderly, economic and safe development of <br />land within the City; and <br />WHEREAS, the City Council has considered the application for a <br />subdivision application of a plat by Paul D. Swanson, President of Landmark <br />Construction, Inc. a Minnesota Corporation, (hereinafter "the subdivider"); <br />and <br />WHEREAS, the subdivision has been found to meet all standards of <br />both the RR-lA and LR-IA zoning districts finding that each lot is of a <br />size and configuration that will allow its use as a single family residence <br />to be fully developed without the need of any variances; and <br />WHEREAS, the subdivider has completed all requirements of the <br />platting regulations of the City, including: <br />1. Completion of all the requirements of Resolution No. 2301. <br />2. Dedication on the plat of right-of-way for a public road, shown <br />as County Road No. 84. <br />3. Dedication on the plat of drainage and utilities easements. <br />Creation of a new private road shewn on the plat as Outlet D, to <br />be known nenceforth as Landmark Drive. <br />5. Concurrent with the creation of this private road, the Subdivider <br />has dedicated to the City a Road and Utilities Easement granting to <br />the City permanent access, improvement and utility easements over said <br />Outlet; the Subdivider has created non—exclusive ingress, egress, <br />drainage and utility easements over said Outlet in favor of all <br />abutting and/or benefiting lots including a declaration of certain <br />maintenance covenants wherein each of the abutting and/or benefiting <br />lot owners covenants and agrees to permanently maintain and pay the <br />cost of maintenance for said private road. <br />Page 1 of 3 <br />r
