None of the nationwide permits ars valid for regulated activities in, <br />or in water or %wtland areas which are within 1000 feet of a boundary of, a <br />ealcareoua fen designated by the Minn'isota Department of Natural Resourcea and <br />listed in Minnesota Ruls 7050. A list of these calcareous fens is attached. <br />Section 401 conditional <br />1. Projects which include dredging in contaminated or polluted areas or <br />that will disturb known contaminated sediments or polluted substances as <br />defined and as listed by HPCA are not authorized under Section 404 by any <br />nationwide permit unless the applicant applies for, and is granted, a <br />project-specific Section 401 certification from MPCA. <br />2. Projects which involve utilization of fill or bank stabilization <br />material which is comprised of demolition debris ars not authorized by any <br />nationwide permit unless the applicant applies for, and Is granted, a <br />project-specific Section 401 certification from MPCA. Demolition debris is <br />defined by Minnesota Rules Chapter 7035.0300 Subp. 30 as solid waste resulting <br />from the demolition of buildings, roads, and other man-made structures <br />including concrete, brick, bituminous concrete, untreated wood, masonry, <br />glass, trees, rock, and plastic building parts.
