The majority of the structure will be located in front of the average lakeshore setback <br />line. The addition will have little impact on the residence structure to the west. The residence <br />to the east side will not be able to view structure as it is entirely blocked by the Troyak <br />residence. No other variances are required. <br />Statement of Hardship <br />Please review Exhibits A and B. Applicant notes that the following unique findings and <br />hardships: <br />1. Home was constructed 85 years ago, prior to the current standards for shoreland <br />development. <br />2. All current standards for development are met except for the average lakeshore <br />setback standard. <br />3. The house to the west has no view windows on the west side. <br />4. The residence on the east will not see the addition as it will be placed entirely <br />behind the existing residence. <br />5. There is a mature woods between the residence to the west and the Troyak <br />residence. <br />6. Staff would add the curvature of the shoreline. <br />Staff Comments <br />In light of certain comments made by applicant to both Council and Planning Commission <br />members, staff feels it necessary to make the following comments: <br />To stafFs knowledge, the first person to view the March 1994 survey of the proposed <br />improvements was the Building Official sometime after the filing of the May 2nd <br />building permit application (review Exhibits H and I). The survey information was <br />complete as staff had advised Mr. Troyak at the time he discussed his proposed <br />improvement that the addition would also be subject to an average lakeshore setback. <br />The need for the variance is not determined by the location of the addition as it relates <br />'■-mm <br />♦
