The property owner proposes to use the property in a reasonable manner not <br />permitted by the Zoning Chapter. <br />Response: reasonable manner that is permitted in the zoning as a one -family dwelling. <br />2. The plight of the landowner is due to circumstances unique to his property not created <br />by the landowner. <br />Response: The variance would be required as the zoning is written today for the existing structure <br />which was originally built in 1930. The size, dimensions and setback of the existing structure are <br />unique to the property. <br />3. The variance, if granted, will not alter the essential character of the locality. <br />Response: None of the variances requested will alter the essential character of the area. We are <br />proposing to replace in general a similar -sized structure to what is currently nonconforming on this lot <br />and others in the direct vicinity. <br />4. Economic considerations alone do not constitute practical difficulties if reasonable use <br />for the property exists under the terms of the Zoning Chapter. <br />Response: There have not been economic considerations in our proposal, we have planned to <br />absorb the costs necessary to comply with the current building code and modern standards. <br />S. Practical difficulties include, but are not limited to, inadequate access to direct sunlight <br />for solar energy systems. Variances shall be granted for earth -sheltered construction as <br />defined in Minnesota Statutes, Section 116106, Subd. 2, when in harmony with this <br />Chapter. <br />Response: There are many practical difficulties in any improvement to this site and our proposal <br />looks to minimize the ask as to provide a modern standard while setting back in an average to the <br />lake, reasonable side and rear setback, and only apply for the minimum hardcover necessary. <br />6. The Board of Appeals and Adjustments or the Council may not permit as a variance any <br />use that is not allowed under this Chapter for property in the zone where the affected <br />person's land is located. <br />Response: The proposed one -family dwelling is a permitted use. <br />7. The Board or Council may permit as a variance the temporary use of a one -family <br />dwelling as a two-family dwelling. <br />Response: The one -family dwelling is a permitted use. <br />8.
