ORDINANCE NO., SECOND SERIES <br />AN ORDINANCE AMENDING ORONO ZONING CODE SECTION 10.56, <br />SUBDIVISION 3, AMENDING THE DEFINITION OF "TOP OF BLUFF" <br />THE ORONO CITY COUNCIL HEREBY ORDAINS: <br />SECTION 1. Orono Municipal Zoning Code, Section 10.56, Subdivision 3, <br />definition 2 "BlufP is amended as follows: <br />4m • <br />"Bluff" - A topographic feature such as a hill, cliff, or embankment having <br />the following characteristics (an area with an average slope of less than 18% over a <br />distance of 50' or more shall not be considered part of the blufO: <br />A. Part or all of the feature is located in a shoreland area; <br />B. ihe slope rises at least 25’ above the Ordinary High Water Level of <br />the water body; <br />C. The grade of the slope from the toe of the bluff to a point 25’ or more <br />above the Ordinary High Water Level averages 30% or greater; and <br />D. The slope must drain toward the water body. <br />2(a). "Toe of the bluff" 'Bluff, toe of the" - The means-the lower point of a <br />50’ segment with an average slope exceeding 18%. "Top of the bluff" means the higher <br />point of a 50’ segment wi^ on average slope exceeding 1 8%. <br />2(hl. "Bluff, ton of the" - That point on the cross-section of a bluff below which <br />the slope becomes more than 18% and above which the average slope for a distance_of <br />50’ or more is 18% or less. <br />SECTION 2. Adoption and Publication Period. This ordinance shall be published <br />in the Pioneer and the Laker newspapers and shall become effective immediately upon <br />publication. <br />Adopted by the City Council of Orono, Minnesota on this 25th day of April, <br />1994, by a vote of_ayes and__nays. <br />Edward J.
