Whitman <br />1570 6lh Avenue North <br />Long Lake, Minnesota 55356 <br />Re: Incomplete Application <br />Dear Mr. and Mrs. Whitman; <br />The City is in receipt of your application for a conditional use permit to construct a driveway <br />within Tract E, Registered Land Survey No. 1418. <br />After reviewing your application, we find that it is incomplete, and therefore cannot be <br />scheduled for the October 18th Planning Commission meeting. <br />The application is considered incomplete because it has not been signed by the owner of Tract <br />E, James F. Law rence. It is standard City practice to require the signature of both the applicant <br />and the property owner where the applicant is not the fee owner of the property. <br />I would also note that the easement agreement included with your application. Document No. <br />1325401 refers a number of times to Easement Document No. 1169844, a copy of which we <br />hereby request that you provide. <br />It is my understanding that you are proceeding to obtain a declaratory judgment in regard to <br />specific rights for use of Tract E. As our city attorney has outlined in a letter to your attorney, <br />such a judgment which clearly confirms your rights to use Tract E as requested in your <br />application, will substitute for the owner’s signature. <br />Also, please have your engineer provide the City with the size of culvert proposed together with <br />supporting information and data.
