This application is regarding a front yard setback variance for a 350 square foot garage <br />addition. <br /> <br />2. MN§15.99 Application Deadline. N/A. <br /> <br />3. Background/ Summary. On July 10, 2023 via Resolution No. 7382, the Council granted a front <br />yard setback variance to permit a 14’ x 25’ garage addition to be constructed 46 feet from the front <br />property line where a 50-foot setback is required. The variance approval was based on a scaled site plan <br />submitted by the applicant. Upon submittal of a building permit application using an updated certificate <br />of survey (as required for home additions) it was determined that the garage addition would be set back <br />44.9 feet from the front property line, not 46 feet as previously shown. The new setback request is the <br />result of using an old survey and an aerial image for the land use application both of which are not as <br />accurate as a certified survey. The practical difficulties identified in Resolution 7382 still apply to the <br />project including the corner lot configuration, the location of the wetland on the property, and the <br />orientation of the existing home on the property and with respect to the road. The garage addition is <br />heavily screened and the updated setback is reasonable for the use of the property. <br /> <br />4. Variance Description. The owners are requesting the Council consider amending Resolution No. <br />7382 to permit the addition to be constructed 44.9 feet from the property line to account for the inaccurate <br />site plan. <br /> <br />5.
