This application is regarding an average lakeshore setback variance for the construction of <br />a three-season porch addition above an existing deck. <br /> <br />2. MN§15.99 Application Deadline. The application was received July 16, 2023 and considered to be <br />complete on July 20, 2023. Therefore the 60-Day review period expires on September 18, 2023. <br /> <br />3. Background/ Summary. The applicant is proposing to construct a screened in porch addition on top <br />of an existing deck. The existing deck encroaches into the average lakeshore setback by approximately 5 <br />feet. The proposed screened in porch would create a new vertical encroachment into the average <br />lakeshore setback and requires a variance. The proposed addition meets all other setbacks including the <br />75-foot lake setback. The hardcover on the site remains unchanged and is conforming. The applicant has <br />shown practical difficulty in the orientation of the lot and location of existing structures. Due to the <br />orientation of the home and neighboring home and the dense row of vegetative screening, the proposed <br />addition will not negatively impact the neighboring property to the south. <br /> <br />4. Planning Commission Vote and Comment. On August 21, 2023, the Planning Commission held a <br />public hearing. The neighboring property owner to the south, 3265 Bohns Point Lane, spoke in support of <br />the project. The Commission reviewed the application voted 5 to 0 on a motion to approve the requested <br />variance as applied. Draft minutes from the Planning Commission are included as Exhibit C. <br /> <br />5. Public Comment. The applicant has provided neighbor acknowledgment forms, but no other public <br />comment has been received. <br /> <br />6. Staff Recommendation.
