<br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br /> <br />NO. 7408 <br /> <br /> <br />1 <br /> <br />A RESOLUTION <br />APPROVING VARIANCES FROM <br />MUNICIPAL ZONING CODE <br />SECTIONS 78-350 & 78-1700 <br /> <br />FILE NO. LA23-000048 <br /> <br /> WHEREAS, on August 23, 2023, on behalf of the property owners, Michael Sharratt of <br />Sharratt Design (hereinafter the “Applicant”), applied for variances from the City Code for the <br />property addressed 3548 Ivy Place and legally described as: <br /> <br />Lot 174, Taylor’s Subdivision of Spring Lake Park Lots, Hennepin County, <br />Minnesota (hereinafter the “Property”); <br /> <br /> WHEREAS, the Applicant has made application to the City of Orono for variances from <br />Orono Municipal Zoning Code Section 78-350 to allow redevelopment of the nonconforming lot <br />0.28 acre in area and 52 feet in width where 0.5 acre and 100 feet of width are required; and <br /> <br />WHEREAS, the Applicant has made application to the City of Orono for a variance from <br />Orono Municipal Zoning Code Section 78-1700 to permit 35.5% hardcover where 25% is <br />required and 44.4% currently exists, in conjunction with redevelopment of the Property; and <br /> <br /> WHEREAS, on September 18, 2023, after published and mailed notice in accordance with <br />Minnesota Statutes and the City Code, the Planning Commission held a public hearing, at which <br />time all persons desiring to be heard concerning this application were given the opportunity to <br />speak thereon; and <br /> <br /> WHEREAS, on September 18, 2023, the Planning Commission recommended approval <br />of the variances by a 6 to 0 vote; and <br /> <br /> WHEREAS, on October 9, 2023 the City Council reviewed the application and the <br />recommendations of the Planning Commission and City staff; and <br /> <br /> NOW, THEREFORE, BE IT RESOLVED that the City Council of Orono, Minnesota <br />hereby approves the requested variances as described above based on one or more of the <br />following findings of fact concerning the Property: <br />
