LA23-000046 <br />September 18, 2023 <br />Page 2 of 5 <br /> <br />Zoning District requires a 2-acre minimum and a minimum width of 200 feet. The subject <br />property is 4,488 square feet (0.1 acres) in size and 44 feet wide. The small lot size coupled with <br />the required setbacks eliminates any compliant buildable area. The subject property does not <br />have any outdoor living space and therefore it is a reasonable request to have a small outdoor <br />deck. However, the deck encroaches into the average lakeshore setback and a redesign could <br />eliminate this variance request. Additionally, the property received variances in 2005 for the <br />construction of the home and the resolution approving those variances (Exhibit H) explicitly <br />state that the homeowner chose to forego a deck in order to minimize hardcover. The <br />resolution goes on to state that any future requests to increase hardcover would likely not be <br />approved without some reduction in hardcover. The applicant has not proposed to eliminate <br />any hardcover on the site, only add to the overall hardcover bringing to total hardcover on the <br />site to 35%. The current home was approved by <br />variances in 2005 due to its extremely small lot size and not having a compliant buildable area. <br />The proposed deck is situated on the south side of the home and will create a new <br />encroachment into the 75-foot lake setback and will also extend into the average lakeshore <br />setback. The home currently complies with the average lakeshore setback, but the new deck <br />would extend approximately 8 feet past the average lakeshore setback line. <br /> <br />
