I* <br />4. <br />A- The parcel would have been buildable without variances at the time the <br />applicant purchased it in 1972. <br />B. Applicant has demonstrated that suitable primarv' and alternate sites for <br />an on-site sewage treatment system exist on the property. <br />C. A single family residence can be constructed on the property meeting the <br />required lot line, wetland and draintield setbacks. <br />D. Construction of a single tamily residence on the property will be in <br />keeping with the rural nature ot the neighborhood. <br />E. The buildable envelope of approximately 140'x400' provides ample area <br />for construction of a single family residence, driveway (already <br />constructed), and on-site sewage treatment systems without impacting <br />neighboring properties. <br />The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City staff, comments <br />by the applicant and the etYcct of the proposed variance on the health, safety and <br />welfare of the community. <br />The City Council finds that the conditions existing on this property are peculiar <br />to it and do not apply generally to other property in this zoning district; tliat <br />granting the variance would not adversely aiTeci traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />serve as a convenience to the applicant, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preser\e a substantial <br />property right of the applicant; and would be in keeping with the spirit and <br />mtent of the Zoning Code and Comprehensive Plan of the City. <br />Page 2 of 5
