I removed the trees <br />without knowing that the property was subject to an easement <br />given to the City by the developer of the property. I bought the <br />1*^ Jtme of this year and the seller represented in the <br />purchase documents that there were no restrictive easements and <br />my title Insurance company failed to find that this easement <br />existed. Thus, X had no knowledge of its existence and 1 would <br />like the Commission' s understanding in light of these unusual <br />circumstances. <br />In addition, I removed some trees within 75 feet of <br />Lake Minnetonka without the City's consent. X have only myself to <br />blame for that. I relied on a neighbor telling me I could remove <br />trees there end it appeared to have been done by others In the <br />area. I would propose to substitute trees for these trees taken <br />in this 75 foot area. <br />My request of the City consists of two Items with <br />respect to my lot: <br />a. A request for a re-delineation of a wetland baaed on <br />a recently concluded expert study of the lot and a request for <br />approval of the removal of trees In the wetland area that is <br />required by a 1978 Easement in favor of the City; and <br />b. A request for a variance for the removal of trees <br />within 75 feet of the shoreline of the lake pursuant to Section <br />10.22 Subd. 3. <br />Each of these requests is described in detail below: <br />Re-delineation of wetland and request for approval of removal of <br />trees: <br />In discussing this Issue with the City’s inspection <br />department, it was suggested that I hire a wetlands expert to <br />determine what part of my property was actually a wetland since <br />it appeared that much of the area was not. Attached to this <br />request is a July 31, 1995 report prepared by Westwood <br />Professional Services, Inc. following testing of my lot according <br />to published federal wetland standards that have been adopted by <br />Mlnxiesota's Wetland Conservation Act of 1991.
