Zoning File #2082 <br />November 14,1995 <br />Page 3 <br />qcli,-pf| to restore groundcovcr per approved plan. The areas east of the newly defined wetland area <br />were to be sodded to prevent further erosion and the remaining disttirbed wetland area was to be <br />restored with seeding using a wetland seed mixture such as Mn DOT mixture 250. In order to ensure <br />erosion control until wetland vegetation was restored, applicant was also asked to cover the seeded <br />areas with mulch and disc anchoring it into the soil. <br />Staff completed an inspection of the restored area finding that everything had been completed as <br />recommended by the City Engineer. Sod has been installed over the entire disturbed area located <br />out of the redefined wetland. Disturbed areas within the wetland show signs that specific types of <br />the seed mixture have started to grow. These areas remain covered with mulch. The Engineer asks <br />that a fmal inspection be completed in early spnng to venfy that the wetland seeding is successfully <br />established. <br />Issues for Consideration <br />1. Applicant has agreed to replant fruit and evergreen trees within the 0-75' setback area where <br />ten trees were removed. Will members require additional plantings? <br />2. Applicant's addendum confirms no knowledge of the existence of the Conservation and <br />Flowage Easement and of the need to receive City approval before trees or groundcover are <br />removed. Applicant has asked that replanting of trees not be required within the newly <br />defined w etland area or in the remainder of the original designated wetUuid. Refer to Exhibit <br />F. will you require replacement trees in the area defined as A or B? <br />3. Other issues raised by the Planning Commission. <br />Vacation - Staff Recommendation <br />Staff recommends approval of the vacation application of Rick Stark involving the property located^ <br />at 575 Oxford Road that seeks to vacate the original conservation area dedicated in the plat of <br />Stielow Addition approved by the City in 1978 based on the soil delineation report by Jay Riggs, <br />Environmental Specialist, of Westwood Professional Services, Inc. dated July 31, 1995 and on the <br />review and approval of the City Engineer. Approval of the vacation is subject to applicant executing <br />a new Conservation and Flowage Easement over the newly defined wetland area. <br />Options of Action for Planning Commission Concerning Conditional Use PcrmitA'ariance <br />Application Involving Tree Removals and Vegetation Clearing within Lakeshorc Protected <br />Area and Conservation Area <br />1.
