A RESOLUTION VACATING <br />A CONSERVATION AND FLOWAGE EASEMENT <br />WITHIN LOT 2, BLOCK 1, KLITZKE ADDITION <br />IN THE CITY OF ORONO, HENNEPIN COUNTY, MINNESOTA <br />FILE NO. 2082 <br />WHEREAS, the Cit>' of Orono is a municipal corporation organized and existing <br />under the laws of the State of Minnesota; and <br />WHEREAS, on October 6, 1995, Richa ’-d MiHer Stark (Tiereinalkr the applicant) <br />filed a petition with the City of Orono requesting the vacation ot a conserv ation iuid tlowage <br />easement orginally dedicated in the plat of Stielow Addition. Hennepin County, Minnesota and <br />legally described as follows; <br />Refer to Exhibit A attached; and <br />WHEREAS, after due published and posted notice, a public hearing was held <br />before the City's Planning Commission on November 20. 1995 regarding said vacation and all <br />interested persons were given an opportunity to be heard; and <br />WHEREAS, after due standing and consideration, the Planning Commission <br />recommended unanimous approval of the proposed vacation; and <br />WHEIHi^AS, the City Council of the City ot Orono finds that said vacation as <br />proposed is in keeping with the public interest and in consideration of the following findings: <br />Applicant’s consultant. Jay Riggs, an En\ ironmental Specialist of Westwood Professional <br />Services, Inc., has submitted a wetland delineation report dated July 31, 1995 locating <br />a wetland area within lakeshore yard of Lot 2. Block 1, KJitzke Addition. <br />The City Engineer Shawn Gustafson in his report dated August 8, 1995 reconfirmed the <br />findings of that wetland delineation report. ITie findings of the report confirm that the <br />wetland area protected under the original conservation easement dedicated in 1978 with <br />the Stielow Addition was incorrectly designated. <br />1. <br />Page 1 of 3
