7. <br />Lot 2, predominately located in the LR-IB Zoning District, is required to maintain <br />1 acre in area and consists of 3.07 acres. <br />The property is not located wthin the Metropolitan Urban Service .Area and shall be <br />developed under rural standards. <br />Septic testing has been approved by the City and confirms that each lot has suitable <br />area for the development of a primar> and alternate mound septic system to be <br />installed in areas at 6% or less slopes. <br />Hennepin County has approved access to Lot 1 via an existing curb cut and Lot 2 <br />shall achieve access via an existing driveway curb cut at the southeast comer of Lot <br />2. <br />Both lots can be residentially developed without the need to grant variances to the <br />applicable zoning standards. <br />NOW, THEREFORE, BE IT RESOLN’ED, that based upon either one or more of <br />findings, the Citv Council of the City of Orono hereby approves the preliminaiy plat for Jensen <br />Homes. Inc. for the property locate.! at 405 Tonkawa Road per the survey dated 9/21/95. most <br />revised date 11/8/95, by Mark S. Gronberg of Coffin and Gronberg. Inc., subject to the follow ing <br />conditions: <br />1.If tennis court that encroaches proposed division line is not removed prior to final <br />plat afproval, applicant shall be responsible for executing a developer’s agreement <br />and posting a letter of credit to ensure structure's removal prior to the City issuing a <br />buildiniz permit for new construction on Lot 2 or within a year ot Council s approval <br />of the final plat whichever occurs first. <br />As required by the subdiv ision regulations, no more than two residential units c:in be <br />serv ed bv the existing easement drive located within Lot 2. <br />3. Access to Lot 1 shall be via an existing curb cut at the County Road. Access to Lot <br />2 shall be via the existing private driv eway at the southeast comer of Lot 2. <br />Page 2 of 5
