City Clerk <br />City of Orono <br />2750 Kelley Parkway <br />Orono, Minnesota 55356 <br />Re: Proposed Special Assessment <br />Willow Drive and Trunk Highway 12 <br />Dear Ms. Hallin: <br />This office is counsel for Orono Plaza, a partnership, and <br />Gilbert C. Braun and Anna Lou Ella Braun, Trustees, regarding the <br />matter of the City's proposed special assessment for work done at <br />the intersection of Willow Drive and Trunk Highway 12 in the City <br />of Orono. <br />Those parties are the owners of Outlot B, Willow Properties <br />Addition, the property westerly of Willow Drive, which property is <br />proposed to be assessed a portion of the costs of the work done at <br />the intersection. <br />Pursuant to Minnesota Statutes Section 429.061, Orono Plaza <br />and Gilbert C. Braun and Anna Lou Ella Braun, Trustees, object to <br />and protest the levy of any assessment against Outlot B, Willow <br />Properties Addition, for the cost of the project. <br />The objection to the levy and the assessment is as follows. <br />Our information is that the City of Orono does not levy special <br />assessments on residential property for improvement projects funded <br />by state aid funds; and that special assessments will be levied <br />upon commercial property for some part of the cost of such <br />improvement projects. Such a practice denies due process and equal <br />protection of the laws to the owners of commercial property. <br />Pending receipt of information on costs and allocation, objections <br />regarding such matters are reserved. <br />Yours very truly.
