CO!JIVCH r- <br />^OV ^7REQUEST FOR COUNCIL ACTION - r <br />DATE: November 20, 1995 <br />ITEM NO: <br />Department Approval: <br />Name Ron Moorse <br />Title City Admmistraior <br />Item Description: <br />Drug and Alcohol Testing Policy <br />Administrator Revie^^^ed:m__Agenda Section: <br />Administrator’s Report <br />Federal regulations mandating a drug and alcohol testing program, for all employees required <br />to have a commercial drivers license in the public sector, were published in February of 1994. <br />These regulations require implementation on January 1. 1995 for large employers (50 or more <br />drivers) and January 1, 1996 for all other employers. For Orono. those employees covered by <br />this regulation are the city ’s Public Works maintenance workers. Because the city has less than <br />50 employees who are required to have a commercial drivers license, we are required to be in <br />compliance with the Federal requirement as ot January' 1, 1996. <br />Federal law requires that cities develop a drug and alcohol testing policy; and that employers <br />provide information to employees on drug and alcohol misuse, the employer s policy, the testing <br />requirements, and how and where employees can get help. All supervisors of these employees <br />must attend at least one hour of training on the signs and symptoms of drug abuse, and one hour <br />of training on alcohol misuse symptoms and indicators used in making determinations for <br />reasonable suspicion testing. <br />Public entities arc required to use a Federally certified lab for conducting any drug specimen <br />analvsis. The new requirements for record keeping are extensive and significant documentation <br />is required throughout the testing process. <br />Drug and Alcohol Testing Policy <br />Orono has panicipated with two groups of cities in developing a drug and alcohol testing policy <br />that meets the requirements of the federal mandate.
