i <br />V ,.*■ <br />A RESOLUTION GRANTING PRELIMINARY <br />APPROVAL OF A CLASS D SUBDIVISBON <br />OF LOT 2, BLOCK 1, BILL KELLEY’S LAND <br />-FILE NO. 2031 <br />WHEREAS, Bruce R. Kelley (hereinafter the "subdivider") on May 26. 1995, filed <br />a formal subdivision application with the City for approval of a tw o loi residential plat of propert)" <br />legally described as: <br />Lot 2, Block 1, Bill Kelley ’s Land, Hennepin Counr/, Minnesota (hereinafter <br />"the property"); and <br />WHEREAS, after due published and mailed notice in accordance with Minnesota <br />Statutes 462.358 et. seq. and the City of Orono's Zoning and Subdivision Codes, the Orono <br />Planning Commission held public hearings on June 19, 1995 and October 16, 1995, at which <br />time all persons desiring to be heard concerning this application were giv'cn the opportunity to <br />speak thereon; and <br />WHERI:AS, at their regular meeting held on November 13, 1995, the Orono <br />City Council considered the subdivision application of the subdivider noting the following <br />findings of fact: <br />1.The property is located within the RR-IB Single Family Rural Residential <br />Zoning District requiring a minimum of two acres of contiguous dr>' buildable <br />land within each newly created lot. <br />The property contains a total of approximately 6 dry acres. There are no <br />designated wetlands within the property. <br />3.The proposed plat consists of two residential lots each meeting the minimum <br />requirement of two acres of dry buildable area. <br />4.Both lots have been found to have adequate and suitable soils for on-site septic <br />treatment facilities. <br />Page 1 of 4 <br />J
