Noted at the <br />time of preliminary plat approval, the original outlot designating the bike trail did not define the <br />actual location of the bike trail. The applicants and City Engineer completed a field inspection of <br />the area and have staked out the bike trail. Members may have observed the preliminary grading of <br />the trail. The City will take an easement over the trail rather than an outlot to be consistent with the <br />City ’s method for obtaining trail-easements with subdivisions. Major portions ot the trail will be <br />located within each lot. Bike trail easement will include a legal description and map locating the <br />trail as it encroaches Lots 1,2 and 3. <br />A declaration of covenants to be filed with the plat includes the obligation of property owners to <br />maintain dl drainage facilities and Lots 3 and 4's responsibility for the sharing in the cost of the <br />maintenance of the City driveway. The surveyor has confirmed that 1,900 s.f. of the bike trail will <br />encroach a Type 1 wetland. Ihe applicants propose the excavation of approximately 7,800 s.f of <br />the City ’s wetland located to the southeast providing mitigation area for the encroachment of the <br />wetland by the Hike trail and prov iding 5,800 s.f of area to be banked by the City for future need. <br />Staff recommends approval of the final plat French Creek Woods subject to the findings and <br />conditions of the resolution enclosed for Council’s review and action. <br />COUNCIL ACTION REQUESTED: <br />To either adopt or amend the enclosed approval resolution <br />r--*f~.FBg-I
