Gehring, 1687 Concordia Street - Conditional Use <br />Permit^'ariance - Resolution <br />Application: Applicants propose the installation of a 2' timber retaining wail approximately 4-5' <br />from shoreline where no structures are allowed. The application also involves construction of a <br />25’x30' accessory structure w ithin the 75-250' setback area that will meet all required setbacks. The <br />property has excessive hardcover, 24.21% within the 0-75' setback. A portion of the proposed <br />garage and part of the access drive w ill encroach the floodplain of Lake Minnetonka requiring a <br />conditional use permit from the City of Orono and a permit from the Watershed District. The <br />Watershed District will review the application at their November 9, 1995. The City is in receipt of <br />staff memo of the Watershed District recommending approval of the application as proposed. <br />Zoning District - LR-IC. <br />Pertinent Ordinances <br />Section 10.03, Subd. 4 - Prohibition. It is unlaw ful to convert, enlarge, reconstruct or alter any <br />structure or use any structure or land for any purpose nor in any manner which is not in conformity <br />with the Zoning Chapter. Applicants have been asked to file a variance application because of the <br />excesses of hardcover within the 0-75' setback area. <br />Section 10.03. Subd. 9 (E) - Accessory structures greater than 750 s.f. are subject to more restrictive <br />setback standards as structure is at 750 s.f. I'he structure need only meet the 10' side setback. I he <br />proposed accessory’ garage will be located 10' from the north and side lot lines. No variance <br />required. <br />Section 10.03. Subd. 9 (D) - Detached garage will have doors facing street. Structure must meet a <br />minimum 30* setback. <br />Required 30' <br />Pr'posed =51' <br />No variance required.
