Re\ lew E.xhibits D. E and F. In the original layout when the store wa.s <br />opened to the public, food serv ice occupied a quarter of the store area with packaged food <br />and other food items such as hot dogs cooked or heated by microwaves. At the time of the <br />opening, Mr. O'Sullivan advised that he was required to get a license from the Health <br />Department as food was prepared on the premises. The food service area provided heated <br />and refrigerated food display units and a counter against the wall that provided additional <br />food items. There were three or four small tables for customers’ con\ enience. <br />The current food ser\ ice area now occupies approximately half of the con\ enience store. A <br />separate counter area has been installed within the middle also providing expresso coffee. <br />Additional stool and counter area is adjacent to the center counter :irea. A separate cash <br />machine is located behind the counter area so that food service customers can make <br />pavments at the tood serv ice counter rather than at the cenir,il cashier. <br />Tlie Building Department does not issue permits for the relocation of internal structures or <br />the installation of new fi.xtures. In late summer, the Building Inspector stopped the <br />installation of a take-out food service window being installed at the northwest comer of the <br />facility. Refer to E.xhibit F. The work was stopped because a building permit had not been <br />issued (Code would have required a building permit for this type of window installation) and <br />the impros ement proposed a major change in the operation of providing food service. When <br />staff compared the current le\el of food service use with the original, staff advised the owner <br />of a need to apply for a conditional use permit for a restaurant use. Mr. O’Sullivan has set <br />aside his plans to install the food service or take-out window at this time. <br />Review Exhibits B and C. During the review of Application «958 in 1987, the applicant <br />made the City aware of the multiple uses and services that would be provided within the <br />convenience store area. The City questioned the need for a zoning amendment for <br />convenience store use with service station and decided against it finding that the physical <br />limitations of this site and standards of the B-1 Code would be adequate (refer specifically <br />to the section of the staff memo in Exhibit C that addressed this very issue).
