As <br />n oted in that memo, in order to approve this vacation and replat. Planning Commission must be <br />able to fiiKl that: <br />-The necessary variances involved in the replat (lot width/frontage/back lot issues) <br />are clearly justified and supported by adequate findings. <br />It is in the public’s best interest to vacate the road. <br />-All utilities and access needs will be accommodated. <br />The vacation is unique and supported by compelling justifications that apply to this <br />neighborhood but not to other similar neighborhoods, in order that a basis to deny <br />similar requests without such conditions existing, is possible (i.e. show why this <br />vacation does not set a negative precedent). <br />Options for Action <br />1.Approval as proposed, subject to: <br />Applicants obtaining formal Hennepin County DOT approval. <br />Subject to confirmation of location of existing utilities, to be relocated or <br />easements granted for them. <br />Minimum setback requested by Levy for Toles driveway (15’ requested). <br />Replat subject to standard drainage and utility easements. <br />Subject to delineation of wetland (topographic basis may be acceptable) and <br />granting of conservation and tlowage easement over wetland. <br />Subject to grading and drainage plan approved by City Engineer/Public Works <br />Department prior to final plat approval.
