F REQUEST FOR COUHCIL ACTION COUNCIL MEETING <br />MTB: October 1595 <br />, (""n'OfOBONOHITEM NO: <br />Ztea Description: <br />Juvenile Curfew Ordinance Change <br />Exhibits: <br />See Attached <br />Discussion: <br />Effective 7/lf9S, Hennepin County adopted an ordinance regarding <br />juvenile curfew. It was found that the Orono curfew ordinance is less <br />restrictive than the ordinance adopted by Hennepin County. <br />Minnesota Statue 145A.05 (Subd. 9) dealing with local ordinances <br />provides that the governing body of cities may adopt ordinances relating to <br />the public health which are authorized by law. However, the ordinances "must <br />not conflict with or bo less restrictive than ordinances adopted by the <br />county board within whose jurisdiction the city or to*ra is located." <br />Because of this change the Orono ordinance must be brought into <br />compliance as required by the above mentioned statute. <br />Attached table reflects comparisons between the Orono ordinance and the <br />Hennepin County ordinance. <br />STAFF RECOMMENDATION: <br />It is recommended the ordinance be: <br />Age 12 and Younger: Home by 9:00 p.m. (all nights) <br />Age 13 thru 14: Home by 10 p.m. (all nights) <br />Age 15 thru 16: <br />Age 17: <br />Home by 11 p.m. (Sunday thru Thursday) <br />Home by Midnight (Friday and Saturday) <br />Home by Midnight (all nights) <br />COUNCILACTION REQUESTED: <br />Motion to approve ordinance 2unending juvenile curfew. <br />forM/cocinci l.act
