MINUTES OF THE REGULAR ORONO CITV’ COUNCIL <br />MEETING HELD ON OCTOBER 9,1995 <br />(#14) GARY DESANTIS, SAILORS WORLD xMARINA AND BOAT CLUB, 1955 <br />SHORELINE DRIVE - L\NDSCAPE PLAN DEADLINE <br />Mabusth reported that a lettor was provided by DeSantis regarding why the landscaping <br />was not completed by the September 15 deadline DeSantis w^ present to answer any <br />questions. <br />Huit asked when the landscaping was initially set tor complaion Mabusth said a year <br />w'as given from the time the permit was issued in 1992. The first e.xpiration date was <br />1993 Hurr felt this was an excessive amount ot extended time and did not recommend <br />any further extension. She noted she had rrad the letter <br />DeSantis said he has been served a tremendous hardship with paying the $40,000 cost for <br />soil clean up and would have otherwise completed the landscaping. He noted the <br />neighbor’s property has contributed to the contamination problem. He said there is now <br />documentation that the gas station would be mitigating the contamination The <br />documentation confirms that the load moves in his direction and has more than likely- <br />affected his property. The document is in a draft form at this time. <br />Hurt asked what would be a reasonable date for completion of the landscaping. DeSantis <br />said the report by the MCP.^ is being reviewed now and was told would take about 2 <br />months to complete. If it w as determined that there was no tiirther leaking, the <br />landscaping could be installed. If monitoring wells were required, DeSantis said he <br />would then need the funds to install both the wells and the landscaping. <br />Goetten said she understt>od there were extenuating circumstances but could not <br />understand why the MPCA was not in contact with the other property owner. It was <br />noted that the property is in foreclosure Jabbour said it was his understanding from the <br />owner that he was going to abandon the propeny This would result in no one being <br />responsible tor the contamination. <br />Hurr asked DeSantis if he vvas eligible for super fund reimbursement. DeSantis said there <br />was a possibility of up to 90® o reimbursement. <br />Hurr asked if the contamination problem was present in 1993 DeSantis said he was <br />unsure of the order of the delay It had been his plan to meet the last deadline of <br />September 15. 1995 and has been frustrated with the process and lack of assistance. <br />DeSantis was asked how the landscaping would be affected He indicated the geoprobes <br />to monitor the soil could possibly disturb any landscaping It was a 9-point process with <br />3 by the road, 3 in the mid section, and 3 by the seawall. DeSantis said he could stagger <br />the landscaping and work around the probes but finds it to he a financial drain <br />Callahan asked DeSantis if the delay now was due to cost or damage to landscaping. <br />DeSantis .said it would be both.
