9 MINUTES OF THE ORONO PLANNING COMMISSION MEETING HELD ON AUGUST 21. 1995
(#14 - #2056 Michael & Barbara Wigic>’ - Connnued)
GafBron reported that the application is for land aheration condiuonai use pe^i and
\"ariance to excavate in the 0-75' zone and to install boulder retaining ualls o e sections
prohibit grading %vithm 75' of the lake, as well as any hardcover in that arex and requires a
CUP for lakeshore alteration.
The application proposes two tiers of boulder wails; one at the top or a 2 1 siope the
other at the base of that slope in the flood plain next to the lake. The walls w oui
a 3:1 slope. A retaining wall at the top of the slope would be extended to maxe t e awn
level, A MCWD permTi is required to build within that flood plain. A
had been turned down by MCVVT) when he appued for their permit. Gafffon said he a
spoken with the MC\VD, who saw no need for the walls GaSiron said he concurs wit
the nndins that the walls would provide no signincant stabilization. Showing an eie\ation
sketch, Gaf&on said the wail would be e.xposed 5-1/2 of the 1 / height at "he a 'e. t^
would be difficult to screen all of this wail, Gadron said Staff sees bttlejusuncation lor
the wails unless there was immment failure of the slopes. WaUs are not normaUy approved
by the City for aesthetic reasons or for surface soil erosion.
The erosion occurring by the house is in the shaded area. Fill would make this area to the
north and south more level and could possible be screenable with vegetauon Sta
currently views the site has having a natural state of shoreline, and changing it as proposed
will yield a layered look of omxmental vegetation The Engineer has iound no problem
with the proposal from an engineering standpoint, but notes there is no ev idence that t e
slope is about to fail.
Gaffion said the hardcover had not been measured. There is mulch with tadne within the
0-7V some of which Gaf&on said should stay and some should be removed There is
likely a need to stabilize the ground where no grass is growing to control the erosion. The
drainage around the house drains towards the neighbor and tans out
Peterson asked the aopiicant why she felt the walls were needed Mrs Wigley said it was
her feelme that erosion was occumng on both sides of the house as well as being the issue
on the hill Her mam concern is for saiety of her family notmg the vegetation on the hi^ is
full of poison ivy and poison oak. Wiglev' did not wish to remove the natural look ot the
hill with crass. She said sne is a mamtenance-tvpe person, wno likes to take care or the
problem before the hill falls down and would like to remove the poisong ivy ana oak
Schroeder said the apoiicant could replace the poison ivy and oak with other vegetation
wilhout requione boulder waUs. Gaiffon said the Citv- feels there is no need to grade I
hiils.de to set nd“of the poison ivy and oala and there is rio slope prool.^ requiring the
wail Ga*on did agree that leveling of the top area would be helprul. Schroeder said he
agreed that erosion wxs occurrmg on the sides of the house, and maybe at the top of the
slope, but did not see any erosion at the bonom.
