CITY of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. .S 4 3J_____ <br />B. <br />C. <br />D. <br />E. <br />A residence had existed on the property for over 40 years until it was <br />destroyed in a fire in 1989. <br />The size and width of the lot is consistent with other properties within the <br />Highwood Road neighborhood. <br />The original residence was located 13* from the street lot line and 3’ from <br />the west side lot line. <br />The new principal structure will be located 23’ from the street lot line and <br />a deck 14’ from the street lot line and 3’ from the west stde lot line. <br />4 The Citv Council finds that the conditions existing on this property are Peculiar <br />to it and do not apply generally to other property in this zoning district, that <br />. granting the variances would not adversely affect traffic conditions ight. air nor <br />pose a'fire hazard or other danger to neighboring property; would not merely <br />Lrve as a convenience to the applicant, but is necessary to a lev,ate a <br />demonstrable hardship or difficulty: is necessary to preserve a substantial proper^ <br />right of the applicant; and would be in keeping with the spirit and intent ot the <br />Zoning Code and Comprehensive Plan of the Citv. <br />^ The Citv Council has considered this application including the findings and <br />recommindations of the Planning Commission, reports by <br />by the applicant and the effect of the proposed variance on the health, safety and <br />welfare of the community. <br />CONCLLSIONS, ORDER .VND CONDI 1 IONS <br />Based upon one or more of Ihe Undines noted above, the Orono City Council <br />n os in Munic’pal 7oninc Code Section 10.25.
