Zoning FUe #2039 <br />August 10, 1995 <br />"'age 3 <br />If members of the Planning Commission can answer affirmatively to the following <br />necessary findings to approve a conditional use permit, then you may grant approval of the <br />conditional use permit subject to conditions set forth in the Engineer ’s repon. Please respond <br />to the following findings: <br />1.Will the proposed location of the pond within the residential lot be in accord with <br />the objectives of the Zoning Chapter and purposes of the zoning district in which <br />the site is located? <br />Will the proposed location of the pond be detrimental to the public health, safety <br />or welfare or materially injurious to properties or improvements in the vicinity? <br />Does the proposed pond comply with all of the applicable provi^sions of the <br />Zoning Chapter? If you cannot answer affirmatively to all of these findings, then <br />you must recommend denial of a conditional use permit. If you vote to <br />recommend approval, the toilowing conditions are applicable; <br />a.Applicant to provide an amended grading plan upon application tor a sratf <br />issued land alteration permit. Contours to reflect a 10:1 bench from the <br />water line to 1’ below the water line and should also reflect the final <br />estimate of the water level ot the pond. <br />Topsoil should be salvaged for respreading over the disturbed areas. <br />These areas should be restored with an acceptable wetland seed mixnire. <br />Staff recommends Mn/DOT mixture 2.*?0. <br />Before scheduling the conditional use permit before Council, staff shall <br />have received the following confirmation : <br />Written confirmation from Watershed District that a permit review <br />will not be necessary. <br />2)Confirmation from Corps as to the type of permit needed to <br />complete their review. If a nationw ide permit is required, this can <br />be achieved in 20-30 days. If an individual permit is required, this <br />will take 90 days to complete. <br />Isv
