[ <br />\\ <br />1' <br />>•/!t <br />CITY of ORONO <br />BtSOtmON OF TTJE.Cm COl NCIL<8 J GNO. <br />4.The City Council fimls that the conditions existing on this property are peculiar <br />to it and do not applv generally to other propeny in this zoning district; iliai <br />granting the variances'would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />serve as a convenience to the applicant, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a substantial property <br />right of the applicant; and would be in keeping with the spirit and intent of the <br />Zoning Code and Compreiiensive Flan of Uic City. <br />5.The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City statf. comments <br />by the applicant and the effect of the proposed variance on the health, safety and <br />welfare of the community. <br />CONCLUSIONS, OKDLU AND CONDITIONS <br />Dased upon one or more of the findings noted above, the Orono City Council <br />hereby grants variances to Municipal Zoning Code Section 10.24. Subdivision 5 (U) to permit <br />constmetion of a new residence on a property that docs not meet the area or width requirements <br />seeking approval of an 18.500 s.f. or 42.6% area Nanarice and 40' or 28.5% lot width variance. <br />subjcCi lo the luHovving conditions: <br />I.Ihe four properties sliall be legally combined prior to the City’s issuance of a <br />building permit. <br />2 All tutuie deveiopment shall be subject to the standards ot the LR-ID Zoning <br />District and Shorcland Regulations of the City. <br />Per Section 10.03. Subdivision 10. the lot is classified as a through lot and all <br />accessory siruciurcs will ici|uiic n conditional use pciinit. <br />()wnei and future developer of property shall be responsible for installing a paved <br />road within the right-of-way of Park Avenue at the same width as the existing <br />paved road to the south.
