V <br />Ar« 3. That area bounded by U.S. Highway 12 on the north. Burlington Northern <br />Railroad on the south and west, and Old Crystal Bay Road on the cast. <br />Area 4. That area hounded by Old Crystal Bay Road on the east. County Road 6 on the <br />north, and U.S. Highway 12 on the south and west. <br />SECTION 3. Study The CouncU hereby refers this matter to the Planning <br />Commission to initiate a study regarding tia implications of the potential need for amendments <br />to the City code to implement the results of that study. <br />SECTION 4. Restrictions on the Granting of Preliminary Subdivision <br />Tnniny (CTTp/Variance) \Dproval. Rezoning. PUD or Building permits. No preliminary' <br />subdivision approval. Zoning (CUP/Variance) approval. Rezoning, PUD or Building Permit <br />approval shall be given by the Council for any propeny within the Highway 12 Corridor as <br />defined herein. <br />SECTION 5. Duration. This Ordinance shall expire on January 22, 1996. <br />without Council action, or it may be repealed earlier if the Council detennines that the requisite <br />studies have been completed and adopted and that appropriate evaluation and action, including <br />any locessary revisions of the zoning code, have beeti finalized. The duration ot this Ordinance <br />cay be extended by adoption of a subsequent Ordinance for a total ot not more than 18 <br />a Iditioiial months. <br />SECTION 6. Variances. The Council may grant a variance to this Ordinance <br />» <he Council finds after careful review of all the facts that a proposal is not contrary to the <br />ntent of the Comprehensive Community Management Plan, that it is compati ‘ with tU zoning <br />and official control amendments being considered by the City, that it doc » 'scly impact <br />the health, safety or welfare of the citizens and that U otherwise meets the requirements of the <br />Orono City Code and state law. <br />SECTION 7. Senarabilitv. Every section. | vision, or part of this Ordinance <br />is declared separable from every other section, provision or, i; and if any section, provision, <br />or pan thereof or action taken hereunder shall be held .nvalid, it shall not atlcct any other <br />section, provision, or part. <br />SECTION 8.
