1. <br />■7 <br />3. <br />Prior to the footing inspection for the new construction, applicant shall remove <br />175 s.f. of stone patio area as shown on Page 5 of this resolution. <br />Authorities granted by this variance run with the property not with the applicant, <br />but are permissive only and must be exercised by application tor a building <br />permit within one year of the date of Council approval, or this variance will <br />expire on that flate (July 24, 1996). <br />Violation of or non-compliance with any of the terms and conditions ol this <br />variance shall constitute a violation of the zoning code, shall automatically <br />terminate any authority granted herein, and shall be punishable as a misdeme.mor. <br />The undersigned applicants have read, understood and hereby agree to the terms <br />ol this resolution and on behalt of themselves, their heirs, successors and assigns, <br />hereby agree to the recording of this resolution in the Chain of Title of the <br />property. <br />Adopted by the City Council of the City of Orono, Minnesota at a regular meeting <br />held on the 24th day of July, 1995. <br />ATTEST: <br />Dorothy M.
