The City Council finds that the conditions existing on this property are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting the variances wotild not adversely attect tratlic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />serve as a convenience to the applicant, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a substantial property <br />right of the applicant; and would be in keeping w ith the spirit and intent of the <br />Zoning Code and Comprehensive Plan of the City. <br />5. The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City staff, comments <br />by the applicant and the effect of the proposed variance on the health, safety and <br />welfare of the community. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby <br />grants variances to Municipal Zoning Code Section 10.61 , Subdivision 2 (A-3) and (C) to permit <br />new signace on the property consisting of a two-sided 4’ x 4’ entry’ pylon sign to be installed <br />at a 13 ’ 8" height and a single-sided illuminated sign at 4’ 2'/6" x 4’ 2'-6" to be attached to the <br />structure at the nonh side and an illuminated apron at the entrance side of the facility, subject <br />to the following conditions: <br />The entrance apron and single-sided building sign shall be illuminated only during <br />the hours when facility is open for use. <br />Applicant’s signage contractor shall met with Bill Warden of the Minnesota <br />Department of Transponation in order to confirm exact location of Highway 12 <br />right-of-way and to ensure minimum 5’ setback would be mainiained. <br />1. <br />Page 2 of 4
