D. Existing improvements on the property encroach into the public right-of- <br />way. <br />E. The existing strucnire is located 18’ from the street lot line where a 30’ <br />setback is required. <br />F. The existing strucnire is located 0’ from the east side lot line where a 10’ <br />setback is required. <br />G. The subject property is consistent with the size and width of other adjacent <br />properties in the immediate neighborhood. <br />H. The new construction will have no impact on residential development as <br />all drainage will drain directly to a ponding area on land owned by City <br />to south and west. <br />4. The City Council fmds that the conditions existing on this property are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting the variances would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />serve as a convenience to the applicant, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a substantial property <br />right of the applicant; and would be in keeping with the spirit and intent of the <br />Zoning Code and Comprehensive Plan of the City. <br />5. The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City staff, comments <br />by the applicant and the effect of the proposed variance on the health, safety and <br />welfare of the community. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Oreno City Council hereby <br />grants a variance to Municipal Zoning Code Section 10.25, Subdivision 6 (B) to permit the <br />construction of a residence on a property that does not meet the required ^ea for the zomiig <br />district and grants a variance of 6,135 s.f. or 28% (per Section 10.03, Subdivision 16 (A-1), <br />variance of 1,779 s.f. or 10%), subject to the following conditions; <br />Page 2 of 4
