§ 10.09 <br />Subd. 6. Conditional Uses: Granting of Permit. <br />A. The Planning Commission may recommend and the <br />Council may grant a conditional use permit as the use permit was <br />aDoli^d for or in modified fornir if on the basis of the application <br />and the evide.nce submitted, the City makes the following findings: <br />1. That the proposed location of the <br />conditional use is in accord with the objectives of the Zoning <br />Chapter and the purposes of the district in which the site is <br />located and Comprehensive Municipal Plan; <br />2. That the proposed location of the <br />conditional use and the proposed condition under which it would be <br />ooerated or maintained would not be detrimental to the public <br />health, safety or welfare, or materially injurious to properties or <br />imoroveraents in the vicinity; and, <br />3^ That the proposed conditional use will <br />comply with each of the applicable provisions of the Zoning <br />Chapter. <br />3. A conditional use permit may be revokable, may <br />be granted for a limited time, or may be granted subject to such <br />conditions as the Council may prescribe. <br />C. A conditional use permit shall remain in effect <br />as long as the conditions agreed upon are observed, but nothing in <br />this Section shall prevent the City from enacting or amending <br />official controls to change the status of conditional uses. <br />D. A certified copy of any conditional use permit <br />shall be filed with the County Recorder or Registrar of Titles of <br />the county or counties in which the City is located for recor . <br />The conditional use permit shall include the legal description of <br />the property included. <br />Source: City Code <br />Effective Date: 4-1-84 <br />Subd. 7. Conditional Uses: Denial of Permit. <br />Council shall set forth contemporaneously in writing and in detail <br />all the reasons for the denial of the conditional use permit appiiā <br />cation. No application for a conditional use permit which <br />denied wholly "or in part shall be resubmitted for a period or six <br />months from the date of said denial, except on grounds of ne <br />evidence or ptoof of changes of conditions found to be valid by cn <br />Planning Commission. <br />Source: Ordinance No. 172 <br />Effective Date: 1-1-75 <br />ORONO CC 270 (4-1-84)
