11.In a small community, city officials have the experience, competence, <br />and capacity to measure the impact of a permit on property values and <br />to weigh and assess similar issues without relying on expert wimesses <br />to determine whether or not the use is in harmony with the general <br />purpose and intent of the zoning ordinance and comprehensive plan. <br />White Bear Parlnng and Storage. Inc, v. City of White Bear Lake. 324 <br />N.W.2d 174 (Minn. 1982). <br />12.As to conflicting expert evidence on an issue, the court is not to weigh <br />the evidence. The court should review the record to determine whether <br />there was legal evidence to support the zoning authority’s decision. <br />Barton Contracting. Inc, v. Citv of Alton, 268 N.W.2d 712 (Minn. <br />1978). <br />XI. CONCLUSION <br />Land use law and the procedures which should be followed to persuade the <br />government to approve the developer’s or conversely to justify a denial of an <br />application (or convince the Court to sustain your position) have become very <br />complex. If you hire experienced experts at the beginning of the application process <br />and create the appropriate record, your chances of success will be improved <br />dramatically and your overall cost in time and money should be less. <br />OI5/2207T7664«/95 Page 102
