Zoning File #1921 <br />April 14. 1994 <br />Page 3 <br />1. <br />a. <br />Grant an easement over Lot 1 in favor of Lot 2 for the existing sewer connection. <br />If this is done, then Lot 1 will have to either: <br />Dig up wetland to connect to the northerly stub. This would require <br />review and approval from a number of agencies and a variance from the <br />City; or . . j .• • •Jack a new stub under County Road 151 at a location to avoid digging m <br />the wetland (jacking may be expensive due to other utilities in the right- <br />of-wav); <br />b. <br />OR <br />Move the existing connection to the southeast corner of Lot 2, to the sewer line <br />in Loma Linda. It appears that the Loma Linda sewer is deep enough to <br />accomplish this. If this option is chosen, then the southerly stub can now be used <br />for the new house on Lot 1. This would avoid an encroachment of the existing <br />home's sewer line across the new vacant lot. <br />Staff recommends that Option 2 be required. <br />Access <br />Access for Lot 2 will remain on Loma Linda. A new access driveway for Lot 1 would <br />have to be on Loma Linda and at least 100’ east of the intersection with North Arm Drive. <br />Existing House Setback <br />With the proposed 25' dedication for Loma Linda, the existing house will be 33.0 from <br />the front lot line where a 35’ setback is normally required. Due to the angling of the house, <br />only a small portion will encroach the front line. Given that this is an existing simation, it is <br />essentially a non-issue. To avoid the technical need for a variance to front setback, the City <br />would have to accept less right-of-way. Staff recommends granting the front setback variance. <br />Other Utility Encroachment? <br />Applicant should be asked to provide information on any other known utilities serving Lot <br />2 that will exist within Lot 1, and if there are, how they will be dealt with. <br />View Easement <br />Applicant should address the intent and purpose of the view easement proposed, a^ <br />address what specific restrictions would be placed on it. Such an easement would have to^ <br />enforced by the owner of Lot 2, since the City would not enforce such a private covenant. 1 he <br />potential exists for the City to unknowingly issue building permits that would violate such an <br />easement.
