A standard lakeshore lot with 55,500 s.f. in area would have yielded much <br />hieher hardcover allowances within the 75-250 seioack zone. <br />C. The propert)’ is located on a peninsula. <br />D. The property contains unique topographical constraints. <br />E. The house has been specifically designed to limit the need for horizontal <br />expansion beyond building footprint to provide additional outdoor <br />recreational space. <br />F. Surface runoff from 25.2% of the total 32.5% of hardcover improvements <br />will be treated within a drainfield area and will not run directly into lake. <br />G. A small wing of the new residence will be at a three-story height. <br />4. The City Council finds that the conditions existing on this property are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting the variance would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />serve as a convenience to the applicant, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a substantial property <br />right of the applicant; and would be in keeping with the spirit and intent of the <br />Zoning Code and Comprehensive Plan of the City. <br />5. The City Council has considered this application including the findings and <br />recommendations of the Plaiuung Commission, reports by City staff, comments <br />by the applicant and the effect of the proposed variance on the health, safety and <br />welfare of the community. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby <br />grants variances to Municipal Zoning Code Sections 10.22, Subdivision 2 granting a hardcover <br />variance within the 75-250’ setback area of 1,037 s.f. or 7.5% and per Section 10.24, <br />Subdivision 5 (A) grants a height variance for a small portion of the residence that will be at a <br />three-story height instead of at 2Vi stories, subject to the following conditions: <br />Page 2 of 5
