5 The City Council finds that the conditions existing on this property are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />erantin2 the variances would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />ser%e as a convenience to the applicant, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a substantial proi^i^ <br />right of the applicant; and would be in keeping with the spirit and intent of the <br />Zoning Code and Comprehensive Plan of the City. <br />6. The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City staff, co^ents <br />by the applicant and the effect of the proposed variance on the health, safety and <br />welfare of the community. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the unique findings or hardships noted above, ^e <br />Orono City Council hereby grants variances to Municipal Zoning ’ <br />Subdivisions 1 (A & B) and 2 to permit construction of a two-story structure with lakeside deck <br />granting setback and hardcover variances as specified above, subject to the following conditions. <br />1. <br />2. <br />3. <br />Hardcover improvements shall be limited to the improvements as shown on the <br />site plan included as Page 6 of this resolution. Hardcover m the 0-75 setback <br />area is approved at 986 s.f. or 26%, in the 75-250’ setback area at 2,901 s.f. or <br />32.4% and in the 250-500’ setback area at 490 s.f. or 34%. <br />All hardcover improvements scheduled for removal shall be completed <br />the footing inspection for the new construction. Applicants’ contractor shall <br />obtain the required demolition permits for the removal of both the principal <br />structure and the accessory shed at 103 s.f. <br />The current applicants and future owners are hereby advised that the granting of <br />these variances has been based on the existing grade-level deck at 300 s.f. located <br />completely in front of the average lakeshore setback line and within the lakeshore <br />protected area and this deck shall not be intensified with roofing or stiuctural enclosures. <br />Page 3 of 6
