Zoning File #2001 <br />March 10, 1995 <br />Page 2 <br />Per Section 10.03, Subd. 9(C-1) tennis courts are not considered an oversized accessory <br />structure but the structure is subject to more restrictive setback standards. Your site inspection <br />will confirm the structure Is located in front of the front line of the principal residence. Section <br />10.03, Subd. 14(D) would also require a minimum 30’ side yard setback. The structure is <br />nonconforming in its present location and variances will be required if major repairs are <br />proposed by applicant or future owner in the future. <br />A new septic system will be installed during the construction period of 1995 in th * e'>st side yard <br />(review Exhibit L). The house installed in 1959 was constructed prior to curreru standards for <br />residential construction within the RR-IA Zoning District. Note if garage is to be attached it <br />would have to be located in the substandard street yard as the entire west side ''f residence is <br />located within 100’ setback. <br />Statement of Hardships <br />Please review Exhibit A-1. <br />Issues for Consideration <br />1. Will the proposed setback for the addition be consistent with the setbacks of developed <br />properties in the immediate area? <br />2. Should the garage addition maintain a minimum 75.7’ setback from the street lot line? <br />Why must garage addition extend 4’ further into street yard?—there is no impact on <br />exterior improvements in yard. Will it have any impact on the overall design of structure <br />or on the proposed interior layout, review Exhibits I and J? <br />Your recommendation for approval must include the following; <br />1.Deadline of fall of 1995 for installation of septic system as residence will Increase <br />from 3 bedrooms to 4 bedrooms. <br />2. Applicant or applicant ’s contractor to review need for either a new culvert or <br />reinstallation of existing culvert to create positive drainage in ditch at public road. <br />3.Notice to applicant and future owners that tennis court is nonconforming requiring <br />variance approval for major structural repairs.
