1. <br />4. <br />Applicant and owner shall be responsible for installing a conforming septic system <br />to ser\'e the four bedroom residence by September 30, 1995. <br />Applicant or applicant’s contractor is encouraged to review the need for either a <br />new culvert or the reinstallation of an existing culvert to create positive drainage <br />in ditch at public roadway. <br />Notice is hereby given to both applicant and future owners that the tennis coun <br />located 9’ from the west side lot line, 34’ from the street lot line and located in <br />front of the front line of the principal structure is recognized as nonconforming <br />requiring variance approvals for major structural repairs. <br />Authorities granted by this variance run with the property not with the applicant, <br />but are permissive only and must be exercised by application for a building <br />permit within one year of the date of Council approval, or this variance will <br />expire on that date (March 27, 1996). <br />Violation of or non-compliance with any of the terms and conditions of this <br />resolution shall constitute a violation of the zoning code, shall automatically <br />terminate any authority granted herein, and shall be punishable as a misdemeanor. <br />The undersigned applicant has read, understood and hereby agrees to the terms <br />of this resolution and on behalf of Powder Packers Inc., its heirs, successors and <br />assigns, hereby agrees to the recording of this resolution in the chain of title of <br />the property. <br />Page 3 of 5
