S 11.10 <br />Subd. 14. Special Requirements For Plats. <br />A. Zoning Regulations. Every plat shall conform to <br />existina zonina regulations and subdivision regulations applicable <br />at the time of Final Plat approval. Variances shall not be <br />aoproved to increase the overall subdivision density above the <br />minimum lot area requirements of the applicable zoning district and <br />this Chapter. <br />B. Public Improvements. The Planning Commission <br />may recommend that all public improvements be installed and <br />dedicated prior to the signing of the Final Plat by the City. If <br />the Planning Commission does not recommend that public <br />imorovements be installed and dedicated prior to signing of the <br />Final Plat by the City, the amount of the bond shall be established <br />bv the Zoning Administrator based upon the recommendation of the <br />City Engineer, which bond shall be submitted by the subdivider at <br />the time of application for Final Plat approval. The Planning <br />Commission shall require the subdivider to indicate on the plat all <br />private and public improvements, which shall be required to be <br />established or extended and any other special requirements deemed <br />necessary by the Planning Commission in order to conform the plat <br />to the Comprehensive Municipal Plan and this Chapter. <br />C. Grading of Site Prior to Final Approval. <br />Subsequent to Preliminary Plat approval by the Council, the <br />subdivider may apply for a land alteration permit from the City and <br />uDon receipt of such permit may commence construction to the grades <br />and elevations required by plans approved by the City. <br />D. Referral to Other Government Agencies or <br />Jurisdictions. Following action by the Council on the Preliminary <br />Plat, the Zoning Administrator will refer the Preliminary Plat and <br />the Council's action to other government agencies or jurisdictions <br />for their review and action as may be appropriate prior to Council <br />action on the Final Plat. _ <br />Subd. 15. Effective Period of Preliminary Subdivision <br />Review. Planning Commission recommendations concerning any Class I <br />Subdivision and the Council resolution concerning any Class II and <br />Class III Preliminary Plat shall remain effective for one year. <br />Failure to file a complete Final Subdivision application within <br />this time period shall be construed as formal withdrawal of the <br />proposed subdivision. For one year following preliminary approval, <br />unless the subdivider and the City agree otherwise, no amendment to <br />a comprehensive plan or official control shall apply to or affect <br />the use, development density, lot size, lot layout, or dedication <br />or platting required or permitted by the approved application. <br />Thereafter, pursuant to its regulations, the City may extend e <br />period by agreement with the subdivider and subject to a <br />applicable performance conditions and requirements, of it n^ay <br />require submission of a new application unless substantial physica <br />ORONO C!436 (4-1-84)
