) <br />3 <br />(Rev.1-91) <br />the applicant. The application shall state that the applicant <br />agrees to reimburse the District for any legal, surveying, <br />engineering, inspection, maintenance or other expenses incurred <br />by the District in excess of the amount of the deposit. <br />Subd. 4. Issuance of License. The Executive Director shall <br />refer the completed application to the Board of Directors who may <br />issue a special license for the installation and operation of the <br />eguipment if it finds: <br />a) that the proposed installation will not be detrimental <br />to the public health, safety, order and convenience; <br />b) that the area to be de-iced be no greater than is <br />necessary to prevent damage to the installation and does not <br />extend nor affect areas beyond the dock use area for which the <br />license is issued; <br />c) that adequate safety precautions will be followed in <br />its installation and operation, including providing a snow fence <br />or approved alternative four feet in height and a minimum of six <br />reflectorized signs; that de-icing will occur only in the <br />permitted area; and that all other requirements as specified in <br />the license will be satisfied; <br />d) that the installation will be properly enclosed and <br />adequately marked and lighted to protect the public; <br />arising out of the operation of the equipment. <br />f) that the applicant will, by the installation of <br />adequate screening, signing, or other and <br />the feeding and congregation of waterfowl and ^1 ic <br />the creation of conditions constituting health hazards or pub <br />nuisances within the licensed area; <br />g) that the applicant has agreed that the i"/tallation <br />will be supervised at all times and has provided the <br />with a 24 hour and an emergency telephone number, an <br />h) that the installation includes an <br />on-off switch located near the de-icing “"it on the and the <br />aoplicant has consented to permitting ° ^ de-icing extendsDistrict to shut off or remove the equipment if de icing extends <br />beyond the authorized area. <br />Subd. 5.
