Building & Zoning Administrator <br />DATE March 17. 1994 <br />SUBJECT: #1909 David and Margaret Vergeyle, 1485 Green Trees Road - Variance <br />Public Hearing <br />Pertioent Ordinances <br />Section 10.56, Definition 2 Bluff - Topographic feamre such as a hill, cliff or embankment <br />having the fo.iowing characteristics (an area with an average slope of less than 18% over a <br />distance of 50 ’ or more shall not be considered part of the bluff): <br />A. Pan or all of the feature is located in a shoreland area; <br />The slope rises at least 25’ above the ordinary high water level of the <br />water body; <br />The grade of the slope from the toe of the bluff to a point 25’ or more <br />above the ordinary high water level averages 30% or greater; and <br />The slope must drain toward the w?ter bixly. <br />B <br />C. <br />D. <br />"Toe of the bluff" means the lower point of a 50 ’ segment with an average slope <br />exceeding 18%. "Top of the bluff" means the higher point of a 50 ’ segment with an <br />average slope exceeding 18%. <br />Defrnion 3 Bluff Impact Zone - A bluff and land located within 20’ from the top of a <br />bluff. <br />Definition 26 Steep Slope - Lands having average slopes of 18% or greater as measured <br />over horizontal distances of 50 ’ or more, that are not bluffs. <br />Section 10.56, Subd. 7, Classification of public waters - Recreational Development Lakes (RD) <br />Tanager Lake 929.4 <br />Section 10.56, Subd. 16(C-1) - Setbacks from shoreline required for struemres =» 100’ <br />Two additional structure setbacks; <br />Setback from top of bluff for structures = 30 ’ <br />Bluff impact zone structures and accessory facilities except stairways, <br />landings and lock boxes must not be placed within bluff impact zone. <br />Section 10.56, Subd. 16(G) - Steep slopes. Any applicant requesting a permit for construction <br />of sewage treatment systems, roads, driveways, structures or other improvements on steep <br />slopes, shall provide adequate information to allow the City to evaluate possible soil erosion
