Seciueeclng. iefore consideration or approval <br />of a replacenent plan, the local governnent unit Wt ensnte <br />that the applicant has eihausted all possibilities to avoid and <br />ninlnlze adverse wetland inpacts according to itquenclng in part <br />8120.0520. <br />The applicant nust demonstrate to the local governnent unit <br />that the replacenent plan conplies with this pact and part <br />8120.OSSO. <br />Subp. 2. Type of repleccneet. The order of preference for <br />the nethod of repUcenent. fron nost preferred to least <br />preferred, is project-specific restoration, project-specific <br />creation, then wetland banking. Nodificatioo or conversion of <br />nondegraded wetlands fron one wetland type to anocher, foe <br />esaaple by inpoundaent of additional water, does not constitute <br />adequate replacenent. Wetlands drained or filled under an <br />erenption nay not be restored for replacenent credit for ten <br />years after draining or filling. <br />Subp. 3. Tiniog of replacenent. teplacenent of wetland <br />values nust be conpleted before or concurrent with the actual <br />draining or filling of a wetland, unless an Irrevocable Kanh^ <br />letter of credit or other security acceptable to the responsible <br />government cnit is subnitted to the responsible governeent unit <br />to guarantee successful completion of the replaceeent. All <br />wetlands to be restored or created (or replacenent must be <br />designated Cor replaceeent before restoration or creation. <br />Submission to the local go/ernment unit cC the inforeaticn <br />required in pact 8U0.05J0 and subsequer.t approval shall be <br />con:ivlereJ evidence oC designation for replaceeent, provided the <br />information is subeitted before the actual restoration oC <br />creacion. <br />Subp. i. Location of replaceeent wetlands. Weplaceeant <br />wetlands shall be located within the same watershed or county as <br />the impacted wetlands, escept that counties cr watersheds in <br />which 80 percent or more oi the presettleeent acreage is Intact <br />■ay accomplish replacement in count les or watersheds in which 50 <br />percent or more of the presetclesent wetland acreage has been <br />filled, drained, or otherwise degraded.
