CITY of ORONO <br />RESOLUTION OF THE CITY COU'NCIL <br />• • <br />NO. p ^ <br />B. <br />r <br />D. <br />E. <br />The former detached garage was located 1*2" from the side lot line and <br />the new structure will be located 10’. <br />The proposed improvement will result in a reduction of hardcover. <br />If garage was placed parallel to street meeting the 10’ side and street <br />setback, a large maple tree would have to be removed. <br />If proposed garage was to meet the 30 ’ street setback, the 10 separation <br />setback between principal structure and detached structure could not be <br />met. <br />4 The City Council finds that the conditions existing on this property are peculiar <br />to it and do not applv generally to other property in this zonmg distnct; that <br />erranting the variance would not adversely affect traffic condiuons, Ught, air nor <br />nose a fire hazard or other danger to neighboring property; would not merely <br />Urve as a convenience to the applicants, but is necessary to aUeviate a <br />demonstrable hardship or difficulty; is necessary to preserve a substantial propeip^ <br />right of the applicants; and would be in keeping with the spirit and intent of the <br />Zoning Code and Comprehensive Plan of the City. <br />5 The City Couned has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City staff, comments <br />by the applicant and the effect of the proposed variance on the health, safety and <br />welfare of the community. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City CouncU hereby <br />• ... fr.
