Zoning File #2086 <br />November 15, 1995 <br />Pi^e 3 <br />1. <br />3. <br />Sediment and pollutant trapping and retention. The open water area will provide tor <br />better sediment trapping. It will also provide greater retention. <br />Storage of surface runoff to prevent or reduce flood damage. Storage capacity will <br />be improved. <br />Fish and wildlife habitat. The existing Type 2/3 wetland serv'cs as a habitat for <br />certain species of wildlife. It is the hope of the applicant to now encourage <br />waterfowi to the open water areas but will result in a loss of habitat for some. <br />4, Recreational use. The frozen water area could certainly serve for winter recreational <br />use. <br />5.Shoreline or bank stabilization. Side slopes of banks will be installed to encourage <br />waterfowl - no potential for future erosion or impact on remaining wetland. <br />6. Not clear if there is any noteworthy reason for creating the open water area for <br />preservation of special wildlife species or vegetation. <br />Section 10.55, Subd. 8 specifically prohibits the alteration of wetlands and any land alterations <br />within 26' of that wetland. Section 10.55 specifically addresses flood plain and wetland issues. <br />Members are encouraged to review Section 10.55 to determine if there are any standards appropriate <br />for the alteration of wetlands. The Code relates specifically to flood plain issues. <br />Refer to your Comprehensive Plan, the sections on environment and natural features. The wetlands <br />of the City function as the natural stormwater retention areas. The current Federal regulations would <br />require that stormw ater runoff be treated before draining into protected wetland areas. Runoff firom <br />two acre rural sites will have a negligible impact on altered wetland. The Comp Plan does not <br />prohibit the creation of open water areas within a wetland area; the CMP is concerned with the <br />preservation of wetlands. <br />General Comments <br />Refer to Exhibit H, the specific designated wetland encroaches several lots within the Old <br />Crystal Bay Road Addition plat. How shall we address other requests of adjacent property <br />owners to excavate open water areas within their portion of this wetland? The existing Type <br />2 and in some sections Type 3 wetlands provides a habitat to wildlife. 6,000+ s.f. of open <br />water area will now attract waterfowl. Staff would recommend that the applicant be required <br />to replace the lost 6,000+ s.f. of Type 2 weUand. We suggest that the replacement be either <br />at the southeast or southwest contiguous with the existing Type 2 wetland. The property at <br />2.25 acres will still retain the 2 acres of dry buildable; 2.25 acres exist <br />2.11 acres adjusted dry.
